0.1 Sammendrag

Banklovkommisjonens niende utredning inneholder i hovedsak forslag til endring av reglene om fornyelse og oppsigelse av forsikringsavtaler i lov om forsikringsavtaler. Forslagene omfatter skadeforsikring, sykeforsikring og ulykkesforsikring. Endringene tar sikte på å styrke forsikringstakerens stilling med hensyn til å avbryte forsikringsforholdet og legge forholdene til rette for økt konkurranse i forsikringsmarkedet.

Kommisjonen forslår en generell omskrivning av kapitlene 3 og 12 i forsikringsavtaleloven. I kapittel 3 som inngår i lovens skadeforsikringsdel, foreslås en ny struktur hvor kapitlet er delt inn i tre deler. I første del er reglene om ansvarstid og fornyelse samlet. Kommisjonen har flyttet forsikringsavtaleloven § 2-3 om informasjon ved fornyelse av forsikringen over til denne delen. Annen del inneholder regler om oppsigelse i forsikringstiden. Tredje del har regler om endring av forsikringsavtalen.

I kapittel 12 som inngår i lovens personforsikringsdel, er reglene som gjelder for hhv. livsforsikring og ulykkes-/sykeforsikring skilt ut i egne deler. I tillegg er det en generell del som gjelder for alle typer personforsikring. Med unntak av en endring i forsikringsavtaleloven § 11-1 om informasjon i forbindelse med tegningen, er det ikke foreslått materielle endringer i reglene for livsforsikring. Når det gjelder ulykkes- og sykeforsikring, er reglene lagt nært opp til reglene for skadeforsikringer, blant annet gjennom henvisninger til reglene i kapittel 3.

De fleste skadeforsikringer, sykeforsikringer og ulykkesforsikringer har en løpetid på ett år. For slike forsikringer skjer det automatisk fornyelse ved utløpet av forsikringstiden med mindre en av partene varsler om at fornyelse ikke skal skje. Dette sentrale prinsippet om automatisk fornyelse foreslås formulert mer direkte i lovteksten enn i dag.

Etter gjeldende rett må forsikringstakeren varsle selskapet senest én måned fra den dag selskapet har sendt forsikringstakeren ordinært premievarsel for den nye perioden. Fristens utløp er således avhengig av når selskapet sender ut det ordinære premievarselet. Sendes varslet ut mer enn én måned før forfall, vil forsikringstakerens rett til å avbryte forsikringsforholdet i forbindelse med fornyelsen være tapt før premievarslet forfaller. De fleste forsikringstakere er neppe kjent med regelen, og selskapene har i dag ingen plikt til å opplyse om den. En del forsikringstakere har opplevd at på det tidspunkt det tas initiativ til å avbryte forsikringen har fristen allerede løpt ut. Kommisjonen foreslår at selskapet i tilknytning til fornyelsen på tydelig måte og skriftlig skal opplyse forsikringstakeren om når fristen løper ut. Slik informasjon skal gis senest to måneder før forsikringstiden løper ut. Forsikringstakerens varsel om unnlatt fornyelse må være kommet frem innen forsikringstidens utløp med mindre en annen frist er fastsatt i forsikringsavtalen. Fristen kan tidligst løpe ut 14 dager før forsikringstidens utløp. Dette innebærer at fristen for å varsle om unnlatt fornyelse vil løpe ut tidligst seks uker etter at selskapet har sendt varsel til forsikringstakeren.

I forsikringstiden kan forsikringstakeren etter gjeldende rett bare si opp forsikringen dersom forsikringsbehovet er falt bort eller det foreligger andre særlige grunner. Kommisjonen foreslår at forsikringstakeren også skal ha rett til å si opp forsikringen i forsikringstiden for flytting til annet selskap. Selskapet skal varsles med en frist på minst én måned. I varslet skal det opplyses om hvilket selskap forsikringen skal flyttes til og flyttetidspunktet.

Ved nytegning av forsikring skal selskapet i nødvendig utstrekning legge forholdene til rette for at forsikringstakeren kan vurdere forsikringstilbudet, og opplyse forsikringstakeren om det er vesentlige begrensninger i dekningen i forhold til det forsikringstakeren med rimelighet kan vente er dekket under vedkommende forsikring, om alternative dekningsformer og om tilleggsdekninger som det markedsfører. Ved anvendelse av denne regelen vil forsikringstakerens behov, slik det blir presentert for selskapet, stå sentralt. Regelen har som formål å medvirke til at forsikringstakeren oppnår en adekvat forsikringsdekning. Ved flytting av forsikring kommer reglene om informasjonsplikt ved tegning til anvendelse i forhold til mottakende selskap. Kommisjonen mener at informasjonsplikten til det selskap som forsikringen flyttes til, står sentralt ved flytting og har derfor gjentatt bestemmelsen om at selskapet skal opplyse forsikringstakeren om vesentlige begrensninger i dekningen.

Ved opphør av forsikringen i forsikringstiden skal forsikringstakeren godskrives overskytende premie. Kommisjonen foreslår en regel om at premierefusjonen skal utgjøre samme forholdsmessige andel av premien som gjenstående forsikringstid utgjør i forhold til den samlede forsikringstid. Hvis forsikringstekniske risikobetraktninger tilsier en annen premierefusjon, kan dette fastsettes i forsikringsvilkårene. Kommisjonens flertall mener at selskapet ved oppsigelse for flytting bør kunne kreve et gebyr for kostnader ved opphøret av forsikringen.

Kommisjonen foreslår regler om at når tegning eller fornyelse gjelder flere forsikringer, skal det opplyses skriftlig om premien for hvert av produktene. Slike opplysninger vil gjøre selskapets ”tilbud” mer transparent. Forslaget må ses i sammenheng med et lignende lovforslag i utredning nr. 6 fra kommisjonen.

0.2 Summary in English

The Banking Law Commission’s ninth report primarily contains proposed amendments to the rules concerning the renewal and termination of insurance contracts in the Act relating to Insurance Contracts. The proposals concern non-life, health and accident insurance. The aims of the changes are to strengthen the position of policy-holders with respect to terminating insurance and to prepare the ground for increased competition in the insurance market.

The Commissionproposes a general revision of Chapters 3 and 12 of the Act relating to Insurance Contracts. A new, tripartite structure is proposed for Chapter 3, which is in the non-life insurance part of the Act. The first part contains the rules concerning the indemnity period and renewal. The Commission has moved Section 2-3 of the Insurance Contract Act concerning information in connection of renewal of insurance to this part. The second part contains rules regarding termination of the contract during the insurance period. The third part contains rules about amending the insurance contract.

In Chapter 12, which is in the part of the Act relating to personal insurance, the rules concerning life insurance and accident/health insurance, respectively, have been placed in separate parts. In addition, there is a general part which concerns all types of personal insurance. With the exception of an amendment to Section 11-1 of the Act concerning information in connection with the effecting of insurance, no material changes have been proposed to the rules for life insurance. The rules for accident and health insurance have been brought closely into line with the rules for non-life insurance, among other things through references to the rules in Chapter 3.

The majority of non-life, health and accident insurance contracts have a term of one year. Contracts for these types of insurance are automatically renewed on the expiry of the insurance period, unless one of the parties gives notice that renewal is not to take place. It is proposed that this key principle regarding automatic renewal be formulated more directly in the text of the Act than it is today.

According to applicable law, the policy-holder must notify the company one month at the latest from the day on which the company has sent the policy-holder ordinary notice of premium due for the next period. The expiry of the deadline thus depends on when the company sends out the ordinary notice of premium due. If the notice is sent out more than one month before the due date, the right of the policy-holder to terminate the insurance relationship in connection with the renewal will be lost prior to the date of payment. Most policy-holders are probably not acquainted with the rule, and at present companies have no obligation to inform them of it. A number of policy-holders have found that on the date when they take the initiative to terminate their insurance, the deadline for doing so has already expired. The Commissionproposes that in connection with renewal the company should inform the policy-holder clearly and in writing of when the deadline expires . This information must be provided at least two months before the insurance period expires. Notice that the policy-holder does not intend to renew the contract must have arrived before the expiry of the insurance period unless a different deadline has been stipulated in the insurance contract. The earliest the deadline can expire is 14 days before the end of the insurance period. This means that the deadline for giving notice of non-renewal will expire a minimum of six weeks after the company has sent notification to the policy-holder.

According to applicable law, the policy-holder can only give notice of termination of the insurance during the insurance period if there is no longer a need for the insurance, or if other special reasons exist. The Commission proposes that the policy-holder should also have the right to give notice of termination of the insurance during the insurance period in order to transfer the insurance to another insurance company. The company shall be notified with a notice period of at least one month. The notice shall include information as to which company the insurance is being transferred to and the date of the transfer.

In connection with the effecting of insurance, the company shall to the extent necessary enable the policy-holder to assess the insurance offer, and inform the policy-holder if there are substantial limitations in the insurance cover compared to what the policy-holder can reasonably expect to be covered under the insurance in question, of alternative forms of insurance cover, and of supplementary insurance cover marketed by the company. When this rule is applied, the policy-holder’s needs as presented to the company will be in focus. The purpose of the rule is to ensure that the policy-holder obtains appropriate insurance cover. In connection with the transfer of insurance, the rules concerning obligation to provide information in connection with the taking out of insurance apply to the replacing company. The Commission is of the view that the obligation to provide information of the company to which the insurance is being transferred is of great importance in connection with transfer, and has therefore repeated the provision that the company shall inform the policy-holder of substantial limitations to the insurance cover provided.

In the event of termination of the insurance during the insurance period, the policy-holder shall be credited with the excess premium. The Commission proposes a rule to the effect that the reimbursed excess premium shall constitute the same proportion of the premium as the remaining insurance period constitutes of the total insurance period. If actuarial risk considerations indicate a different reimbursement of the premium, this can be stipulated in the terms and conditions of the insurance. The Commission’smajority is of the opinion that in connection with notification of a transfer, the existing company should have the opportunity to levy a charge for costs associated with the termination of the insurance.

The Commission proposes rules to the effect that when the effecting or the renewal concerns more than one insurance policy, written information should be provided concerning the premium for each of the products. This information will make the company’s ”offer” more transparent. The proposal must be viewed in relation to a similar proposal in the Report no. 6 from the Commission.
