2 Sammendrag

2.1 Norsk sammendrag

2.1.1 Innledning

Forvaltningslovutvalget ble oppnevnt ved kongelig resolusjon 23. oktober 2015 for å foreta en samlet gjennomgåelse av den eksisterende forvaltningsloven og tilgrensende ulovfestet forvaltningsrett. Mandatet for utvalget peker på tre hovedformål med utredningsarbeidet: (1) å vurdere behov for endringer på bakgrunn av dagens praksis, (2) å utarbeide en forståelig og brukervennlig lov som gir grunnlag for en god saksbehandling som ivaretar borgernes og private virksomheters rettssikkerhet og tillit til forvaltningen, samtidig som loven legger til rette for effektivitet og demokratisk styring innenfor rammen av ulike organisasjonsformer, og (3) å utarbeide en lov som legger forholdene til rette for og bygger på at en stor del av saksbehandlingen i forvaltningen skjer eller vil skje digitalt.

2.1.2 Generelt om utvalgets forslag

Utvalget foreslår en ny lov om saksbehandlingen i offentlig forvaltning (forvaltningsloven). Lovforslaget vil avløse den gjeldende forvaltningsloven fra 1967. Både mandatet for utvalget og de erfaringer utvalget har innhentet, gir inntrykk av at gjeldende lov etter alminnelig oppfatning er velfungerende. Samtidig er det behov for endringer på flere punkter.

Lovforslaget er inndelt i 15 kapitler med i alt 95 paragrafer. Det er flere paragrafer enn i gjeldende lov. Fortsatt står reglene om saksbehandlingen i sentrum. Lovforslaget har med regler om forskjellige spørsmål som den gjeldende forvaltningsloven ikke regulerer: forvaltningsspråket, delegering av offentlig myndighet i statsforvaltningen, organisering og saksbehandling i kollegiale organer (nemnder) i statsforvaltningen, uavhengige organer i statsforvaltningen, og enkelte spørsmål om innholdet av forvaltningsvedtak.

Utvalget har lagt vekt på å foreslå en oppbygging og språkdrakt som skal gjøre den nye loven så enkel som mulig å sette seg inn i og å bruke, både for offentlig forvaltning og publikum. De enkelte paragrafene er utformet med sikte på å oppfylle målet om klart språk i offentlig forvaltning og i lovgivningen. Utvalget har i dette arbeidet hatt bistand fra Språkrådet, også til å utarbeide en nynorsk parallelltekst av lovforslaget.

Hovedformålet med loven er å legge til rette for at forvaltningens saksbehandling er god, tillitskapende og effektiv. Utvalget legger stor vekt på at den må gi borgerne tillit til offentlig forvaltning, og ser en velfungerende forvaltning som et sentralt bidrag i et demokratisk styresett. I den formålsparagrafen som utvalget foreslår, fremheves saklig opptreden og samarbeid mellom forvaltningsorganer som grunnleggende for å nå lovens formål.

Lovforslaget har med regler om forskrifter, inhabilitet, veiledningsplikt, taushetsplikt, saksforberedelse, form og begrunnelse for vedtak, klage, omgjøring uten klage og andre spørsmål som er regulert i den gjeldende loven. Hovedtrekkene i forvaltningsloven blir videreført. Det er lagt vekt på å gi bestemmelser som videreføres, en klar utforming i moderne språkdrakt, slik at det blir enklere å bruke dem. Det vil fortsatt være slik at lovens regler kan bli supplert med særregler i lovgivningen på det enkelte forvaltningsområdet.

Utvalget har vurdert den gjeldende loven i lys av endringer i forvaltningens organisasjon, arbeidsmåte og oppgaver og internasjonale forpliktelser, blant annet EØS-avtalen og internasjonale menneskerettskonvensjoner. Utvalget har latt seg inspirere av forvaltningslovene i de andre nordiske landene.

Utvalget foreslår en klarere avgrensning av lovens virkeområde. Loven skal gjelde for offentlig forvaltning i staten, fylkeskommunene og kommunene. Den skal gjelde for andre når de utøver offentlig myndighet, enten det er private eller offentlige virksomheter som er organisert utenfor stat og kommune. For offentlig eide selskaper (statsforetak, særlovselskaper, offentlig eide aksjeselskaper, interkommunale selskaper eller stiftelser med offentlig tilknytning) må det bestemmes i den særlov som regulerer foretakstypen, eller for det enkelte foretak, om forvaltningsloven skal gjelde for annen virksomhet enn offentlig myndighetsutøving.

Det er lagt vekt på at loven skal fungere like godt i kommunene som i staten. Utvalget har lagt kommuneloven av 2018 til grunn i sitt arbeid.

Lovforslaget har nærmere saksbehandlingsregler for enkeltvedtak, i likhet med gjeldende lov. Utvalget anser det ikke hensiktsmessig å innføre flere sett saksbehandlingsregler for ulike typer avgjørelser. De nærmere saksbehandlingsreglene skal gjelde for offentlig myndighetsutøving i enkelttilfeller. Utvalget foreslår å klargjøre i loven hvilke avgjørelser som skal regnes som enkeltvedtak. Utvalget foreslår nærmere saksbehandlingsregler for enkeltvedtak som er fleksible nok til å sikre en hensiktsmessig og effektiv behandling av forskjellige typer saker, samtidig som de gir borgerne tillit til offentlig forvaltning.

Lovforslaget legger til rette for videre digitalisering av forvaltningsvirksomheten. De enkelte reglene er som utgangspunkt ment å fungere teknologinøytralt. Det er lagt til rette for helautomatisert saksbehandling etter nærmere vurdering på det aktuelle området, med krav om offentlig tilgjengelig dokumentasjon av systemets rettslige innhold. Utvalget har også utredet særlige utfordringer digitalisering og automatisering medfører for personvernet, som reiser vanskelige nasjonale og folkerettslige problemstillinger, jf. særlig EUs personvernforordning. Utvalget foreslår en utvidet adgang til å dele taushetsbelagt informasjon mellom forvaltningsorganer i staten, fylkeskommunene og kommunene. For personopplysninger foreslås dette på vilkår som oppfyller kravene i personvernforordningen.

Reglene om inhabilitet er gjennomgått. Utvalget går inn for å beholde terskelen for når inhabilitet inntrer, men foreslår at enkelte situasjoner som i dag gjerne fører til inhabilitet etter en skjønnsmessig helhetsvurdering, skal lede til inhabilitet uten videre. Dette gjelder blant annet for den som har en vesentlig økonomisk interesse i utfallet av en sak. Utvalget foreslår også inhabilitet for den som det siste året før saken begynte, har hatt verv eller ledende stilling i et selskap som er part i saken. Den som har avgjort en forvaltningssak i første instans, blir etter forslaget inhabil til å behandle klagesaken. Når det gjelder inhabilitet etter en skjønnsmessig helhetsvurdering, foreslår utvalget å lovfeste flere elementer i vurderingstemaet. Utvalget foreslår at inhabilitetsreglene skal gjelde formelt også for medlemmer av regjeringen, unntatt for klagesaker til Kongen.

Utvalget foreslår å opprettholde gjeldende ordning om forvaltningsklage og om hvilket organ som er klageinstans. Samtidig understreker utvalget at det må sikres at klageinstansen har en organisatorisk plassering som gir den tilstrekkelig distanse til underinstansen. I statsforvaltningen gjelder dette både når klageinstansen er «nærmest overordnet organ», og når den er en særskilt klagenemnd. Det er delte meninger i utvalget om hvor langt en statlig klageinstans skal kunne overprøve forvaltningsskjønnet i et vedtak truffet av en kommune eller fylkeskommune. Et flertall i utvalget foreslår å oppheve retten til sakskostnader i forvaltningssaker.

Utvalget analyserer hva det innebærer at et forvaltningsorgan er «uavhengig». Det drøfter bruken av uavhengige organer i statsforvaltningen og trekker opp retningslinjer for organiseringen og fremtidig etablering av uavhengige organer.

Utredningens nærmere innhold oppsummeres mer i detalj nedenfor. For en oversikt over de viktigste endringene som foreslås, vises også til kapittel 36, hvor utvalget gjør rede for økonomiske, administrative og rettssikkerhetsmessige konsekvenser av endringsforslagene.

2.1.3 Oversikt over utredningens oppbygging og enkelte kapitler

Utredningen inneholder 35 kapitler som samlet begrunner utvalgets forslag til ny forvaltningslov.

I kapittel 3 er det gitt en fremstilling av utvalgets arbeid.

Kapittel 4 gir en fremstilling av utviklingstrekk i offentlig forvaltning. Tyngdepunktet ligger her på utviklingen i forvaltningens organisasjon, oppgaver og arbeidsmåte etter 1960. I kapittel 5 beskriver utvalget forvaltningens organisering og oppgaver i 2019. Kapitlene gir en faktisk beskrivelse av den virkelighet som forvaltningsretten regulerer.

I skjæringspunktet mellom en rettslig og faktisk beskrivelse kommer kapittel 6, som gir en fremstilling av hovedinnholdet i forvaltningsloven og lovens historie frem til i dag. Kapittel 6 redegjør også for forholdet mellom forvaltningsloven og forvaltningsrettslige regler i annen lovgivning (særlovgivningen) og forholdet mellom forvaltningsloven og ulovfestede forvaltningsrettslige regler (prosessuelle, personelle, organisatoriske og materielle regler). Dessuten har utvalget beskrevet sitt inntrykk av forvaltningsloven i praksis.

Utredningens kapittel 7 gir en samlet og overordnet fremstilling av de viktigste internasjonale forpliktelsene som påhviler Norge, og som har betydning for utformingen av en ny forvaltningslov. I kapitlet beskrives sentrale folkerettslige forpliktelser som bl.a. følger av menneskerettighetene, herunder EMK og relevante FN-traktater og EU-/EØS-retten. I tillegg er det gjort rede for enkelte andre forpliktelser og føringer, som f.eks. Århuskonvensjonen, urfolkskonvensjonen og konvensjoner om anti-korrupsjonsarbeid, i tillegg til enkelte europarådsrekommandasjoner. Som det fremgår av kapitlet, er det de færreste folkerettslige forpliktelsene som gir prosessuelle rettigheter til enkeltpersoner som er involvert i forvaltningssaker. I stedet legger flere av dem føringer på hvordan offentlige organer skal organiseres, og hvordan tjenestepersoner skal opptre i sitt virke som tjenesteperson for det offentlige.

I kapittel 8 er det gitt en samlet fremstilling av hovedtrekkene i alle de nordiske forvaltningslovene.

Kapitlene 3 til 8 har til felles at de danner et faktisk – og i noen grad et rettslig – bakteppe for utrednings- og revisjonsarbeidet. Fra og med kapittel 9 blir utredningen mer konkret når det gjelder behovet for og forslaget til ny forvaltningslov.

I kapittel 9 drøfter utvalget behovet for å revidere forvaltningsloven. Det gjøres rede for generelle synspunkter på lovrevisjonen. Viktige spørsmål som tas opp, er hvilke verdier som står sentralt i forvaltningens virke, hvilke oppgaver, virkemidler og arbeidsmåter forvaltningen har, og hvilken utforming og struktur en ny forvaltningslov bør få. Også hvilket behov det er for en ny lov fremfor å revidere den gjeldende, blir vurdert nærmere. Utvalget velger å foreslå en ny lov, som skal være tilpasset forventninger og utviklingen i forvaltningens organisering og arbeidsmåter, og som skal være utformet i klart språk.

I kapittel 10 bygger utvalget videre på drøftelsene i kapittel 9 og drøfter hvilke verdier, forventninger og formål forvaltningsloven skal ivareta. Utvalget legger her til grunn at rettssikkerhet, effektivitet, nøktern ressursbruk, demokratisk styring og tillit er de sentrale hensynene en ny lov bør bygge på. Drøftelsen munner ut i en diskusjon om lovens formål, og utvalget foreslår en formålsbestemmelse som skal gi uttrykk for at loven skal legge til rette for en god, tillitskapende og effektiv saksbehandling i offentlig forvaltning, som ivaretar hensynet til både den enkelte og samfunnet.

I kapittel 11 drøfter utvalget generelle spørsmål knyttet til forvaltningslovens innhold. Mer presist er det spørsmål om forvaltningsloven bør være en minimumslov eller motsatt gi en uttømmende regulering av forvaltningens virksomhet. Dette har betydning for hvilke regler utvalget skal vurdere og eventuelt foreslå – spørsmål som konkret drøftes i punkt 11.9. Videre er det spørsmål hvordan saksbehandlingen i offentlig forvaltning kan styres på ulike måter, herunder om forholdet mellom lovregulering, generelle instrukser, etiske retningslinjer og kravet om god forvaltningsskikk, jf. punkt 11.4–11.5. Et hovedspørsmål er om det bør lovfestes generelle prinsipper for saksbehandlingen, jf. punkt 11.6–11.7, og det drøftes om det bør innføres et rettslig krav om forsvarlig systeminnretning, jf. punkt 11.8. Utvalget foreslår at loven i utgangspunktet skal gjelde for alle saker offentlig forvaltning behandler. Det skal etter behov fortsatt kunne gis særregler for enkelte sakstyper eller forvaltningsorganer. Det foreslås inntatt som en del av formålsbestemmelsen at forvaltningsorganer skal drive sin virksomhet basert på saklighet og samarbeid – to rettesnorer som utvalget anser som sentrale for en god og effektiv forvaltning.

I kapittel 12 drøfter utvalget hvilket virkeområde loven skal ha, dvs. for hvilke organer og hvilken virksomhet loven skal gjelde. Utvalget foreslår at loven som i dag skal gjelde for alle forvaltningsorganer i staten, fylkeskommunene og kommunene. Loven skal ikke gjelde for Stortinget og organer for Stortinget, og heller ikke for domstolene. Utvalget drøfter nærmere særspørsmål om statsforetak, særlovselskaper og interkommunale selskaper, andre selskaper og sammenslutninger og stiftelser og fond, men kommer til at hensynet til klare skillelinjer og enkle regler taler for at disse bare skal omfattes av loven når de utøver offentlig myndighet. Private skal være omfattet av loven når de utøver delegert offentlig myndighet. Loven skal som i dag ikke gjelde for politiet og påtalemyndigheten i saker som de behandler etter straffeprosessloven.

Kapittel 13 gjelder et knippe regler av generell relevans for bortimot alle forvaltningssaker. Her drøftes forhold knyttet til oppstart av en forvaltningssak, forholdet mellom saksforberedelse og avgjørelse, avgjørelser ved maskinell saksbehandling og andre muligheter ved digitalisering og forholdet mellom skriftlig og muntlig saksbehandling, jf. punkt 13.1–13.4. Drøftelsene munner bl.a. ut i et forslag om å videreføre hovedregelen om at saksbehandlingen skal være skriftlig, samtidig som at loven skal legge til rette for videre digitalisering av forvaltningsvirksomheten. Skriftlighet skal sikre grundighet, mens digitalisering skal sikre effektivitet.

Videre er det i punkt 13.5 drøftet en rekke spørsmål knyttet til språket i forvaltningen. Utvalget legger vekt på at det er ønskelig med en forvaltning som formulerer seg korrekt, klart og brukerrettet. Samtidig bør forvaltningen i ulike sammenhenger være behjelpelige også med å oversette dokumenter for parter der det er behov for det. Utvalget foreslår å lovfeste at språket i forvaltningen er norsk, og at forvaltningsorganet skal kommunisere på klart og presist språk som så vidt mulig er tilpasset den enkelte. I tillegg er det foreslått enkelte regler om oversetting av sentrale dokumenter, mens regler om tolking er foreslått inntatt i en eventuell lov om tolking i offentlig sektor, på bakgrunn av forslaget i NOU 2014: 8 om tolking i offentlig sektor.

I punkt 13.6 drøfter utvalget det generelle spørsmålet om hvem som bør anses som parter med utvidete rettigheter i enkelte forvaltningssaker. Utvalget foreslår en ny legaldefinisjon med sikte på å klargjøre partsbegrepet. I punkt 13.7 drøfter utvalget viktige spørsmål knyttet til saksbehandlingstiden i forvaltningen, bl.a. hvilke virkemidler som kan tenkes å bidra til raskere saksavvikling. Utvalget foreslår at forvaltningsorganer skal måtte opplyse om sannsynlig saksbehandlingstid når de mottar en søknad, eller senest ved foreløpig svar innen en måned. Det legges også opp til at saksbehandlingstiden kan presiseres nærmere i særovgivningen eller i forskrift. I punkt 13.8 drøfter utvalget endelig hvordan de generelle kostnadene ved saksbehandlingen bør fordeles mellom det offentlige og private. Spørsmålet er om det bør være anledning til å ta gebyr for behandling av saker, herunder klagesaker. Utvalget foreslår å videreføre en forskriftshjemmel for dette, men at gebyr for klagesaker skal betales tilbake om klagen fører frem helt eller delvis.

I kapittel 14 reiser utvalget organisatoriske spørsmål knyttet til myndighetsfordeling i offentlig forvaltning. Enkelte sentrale spørsmål er hvilke plikter det enkelte forvaltningsorgan (i motsetning til flere forvaltningsorganer eller forvaltningen som sådan) har under saksbehandlingen, og hva som skal regnes som ett forvaltningsorgan (til forskjell fra andre forvaltningsorganer). Utvalget drøfter også hvordan saksbehandlingen i saker hvor det treffes flere avgjørelser i fellesskap, kan samordnes, jf. punkt 14.3.4.

I kapittel 15 drøfter utvalget spørsmål om delegering av myndighet i offentlig forvaltning. Hovedvekten av drøftelsen ligger på delegering i statsforvaltningen, jf. punkt 15.6. Behovet for delegering og lovfesting av regler om delegering er drøftet i punkt 15.5. Utvalget mener at reglene om delegering bør lovfestes, bl.a. fordi det kan bidra til ryddigere delegeringsprosesser og et mer oversiktlig myndighetskart. Ikke minst er det viktig med regler der delegeringen skjer til private. Dette drøftes særskilt i punkt 15.6.7. Utvalget foreslår flere delegeringsregler, bl.a. om adgangen til å delegere og enkelte krav til selve delegeringsvedtaket. Reglene skal i all hovedsak gjelde for delegering fra statsforvaltningsorganer. Utvalget drøfter også spørsmål knyttet til bruk av private i saksforberedelsen, jf. punkt 15.9.2, og foreslår en regel som gir adgang til slik bruk, men som pålegger organet en plikt til å vurdere saken selvstendig før vedtak treffes.

I kapittel 16 tar utvalget opp spørsmål om inhabilitet for tjenestepersoner. Utvalget foreslår å forenkle reglene ved språklige og strukturelle endringer sammenlignet med gjeldende inhabilitetsregler. I tillegg er det foreslått innholdsmessige endringer som gjør at flere forhold fører til inhabilitet uten videre, som f.eks. likestilling av samboerskap med ekteskap, utvidelse av hvilke slektskapsrelasjoner som fører til inhabilitet uten videre, innføring av vennskap og uvennskap som inhabilitetsgrunn og innføring av en karanteneperiode på ett år ved visse representasjonsforhold. Vurderingstemaet ved inhabilitet etter en skjønnsmessig helhetsvurdering foreslås utdypet og presisert. Reglene i forvaltningsloven skal som utgangspunkt gjelde for statsråder også når de opptrer som medlem av regjeringen.

I kapittel 17 drøfter utvalget alminnelige spørsmål knyttet til forvaltningens informasjons- og veiledningsvirksomhet. Utvalget drøfter hvorvidt forvaltningsloven bør gi en regel om generell informasjonsplikt for forvaltningsorganene, men avstår fra å fremme forslag om dette. Videre foreslår utvalget å videreføre reglene om forvaltningsorganets alminnelige veiledningsplikt, og utvalget foreslår regler med sikte på å klargjøre denne pliktens innhold og omfang. I tillegg foreslår utvalget å lovfeste veiledningskrav som i dag følger av forvaltningslovforskriften, først og fremst knyttet til fremgangsmåten ved veiledning.

I kapittel 18 drøfter utvalget særskilte spørsmål om digital saksbehandling og kommunikasjon. Sentralt står spørsmål knyttet til automatiserte beslutningsprosesser, jf. punkt 18.3.3. Slike beslutningsprosesser reiser vanskelige spørsmål knyttet til rettsgrunnlag for å behandle personopplysninger helautomatisert, dokumentasjon av beslutningssystemenes innhold, offentlighet om det rettslige systeminnholdet, avvikshåndtering, profilering og kunstig intelligens. Dette er drøftet av utvalget under punkt 18.3. Dette temaet reiser også spørsmål om hvordan forvaltningsloven bør samordnes med de krav som stilles til behandlingen av personopplysninger, slik de følger av personvernforordningen. Ett av grepene utvalget gjør for at forvaltningsloven og reglene om personvern skal harmonere godt, er å gi en hjemmel for forskrift om at forvaltningsorganer på bestemte sakområder kan treffe avgjørelser ved helautomatisert saksbehandling. Dessuten bestemmes det at avgjørelser som er lite inngripende overfor den enkelte, kan treffes uten hjemmel i forskrift. I tillegg foreslår utvalget å lovfeste visse krav til dokumentasjon for automatiserte beslutningssystemer.

I punkt 18.3.4 drøfter utvalget hvorvidt borgerne skal ha rett og eventuelt plikt til å kommunisere digitalt med forvaltningen. I denne problemstillingen ligger spørsmål om bl.a. tilgjengelighet, effektivitet og ressursbruk for øvrig, som utvalget går nærmere inn på. Utvalget foreslår ingen slik plikt for borgeren, men i stedet en plikt for forvaltningen til å være tilgjengelig og legge til rette for at den enkelte kan ta kontakt på en sikker og effektiv måte.

Kapittel 19 gjelder taushetsplikt og informasjonsdeling. Reglene om taushetsplikt regnes av mange som spesielt kompliserte. Samtidig ivaretar reglene viktige hensyn ved å beskytte personlige og andre sensitive opplysninger. Brudd på reglene er derfor belagt med straffansvar. Utvalget drøfter muligheten for å presisere reglene om hvilke opplysninger som er underlagt taushetsplikt, men foreslår ikke grunnleggende lovendringer. Utvalget drøfter i punkt 19.8–19.11 spørsmål om taushetspliktens innhold, hvem som bør ha taushetsplikt, hvilke opplysninger som skal være taushetsbelagte, hvilke begrensninger i taushetsplikten som skal gjelde, og når taushetsplikten bør bortfalle.

I tillegg drøfter utvalget som nevnt også spørsmål om informasjonsdeling, jf. punkt 19.12. På dette punktet gjør personvernforordningen seg gjeldende med styrke, ettersom deling av opplysninger som er undergitt taushetsplikt, ofte innebærer behandling av personopplysninger. Utvalget drøfter bl.a. om deling bør kunne skje, og i så fall i hvilken utstrekning. Mens det såkalte «once only»-prinsippet taler for at deling bør kunne skje i stor utstrekning, trekker personvernhensyn i motsatt retning. Utvalget drøfter i punktene 19.12.3–19.12.10 deling med sakens parter og deres representanter, organintern deling, deling med andre forvaltningsorganer og flere andre spørsmål om deling. Utvalget foreslår at opplysninger i større grad skal kunne deles mellom forvaltningsorganer i tråd med «once only»-prinsippet, men likevel slik at personvernhensyn ikke skal neglisjeres. Forslaget er ment å bidra til en mer smidig og effektiv informasjonshåndtering i det offentlige, og dermed også en bedre saksbehandling for den enkelte. For å beskytte opplysninger som er undergitt taushetsplikt, foreslår utvalget regler om tilgangskontroll og sporbarhet.

Felles for de kapitlene som er drøftet til nå, er at de som utgangspunkt har generell interesse for forvaltningsorganene ved at de fleste spørsmålene kan melde seg uavhengig av forvaltningsvirksomhetens art. I kapittel 20 går utvalget videre og spør om enkelte avgjørelsestyper bør reguleres nærmere. Et hovedspørsmål er hvilke avgjørelser de enkelte bestemmelsene i loven, herunder de særlige saksbehandlingsreglene, skal gjelde for. Oppmerksomheten er særlig rettet mot i hvilken grad realitetsavgjørelser skal særreguleres, og i så fall hvilke realitetsavgjørelser dette er aktuelt for. I realiteten drøftes her skillet mellom enkeltvedtak og andre avgjørelser. Dels er spørsmålet hvordan enkeltvedtaksbegrepet skal avgrenses, dels hvilke regler andre avgjørelser skal underkastes. Utvalget konkluderer med at det fortsatt skal gjelde særregler for realitetsavgjørelser som treffes under utøving av offentlig myndighet, og at disse fremdeles bør betegnes som enkeltvedtak. Utvalget foreslår en ny legaldefinisjon av enkeltvedtaksbegrepet med sikte på å klargjøre hvilke avgjørelser det dreier seg om. Loven skal angi enkelte avgjørelsestyper som alltid skal regnes som enkeltvedtak.

Temaene som drøftes i kapittel 21 til 25, har det til felles at de først og fremst gjelder saksforberedelse i saker om enkeltvedtak. Kapittel 21 tar for seg utredningsplikten. Utvalget drøfter utredningspliktens innhold og omfang. Spørsmålet er hvilken plikt forvaltningsorganet skal ha til å sørge for at avgjørelsesgrunnlaget i saken er godt nok til å treffe en god avgjørelse. Utredningsplikten reiser spørsmål om avveiningen av hensynet til grundighet mot hensynet til en rimelig ressursbruk. Utvalget foreslår langt på vei en videreføring av gjeldende regler, men med språklige og strukturelle endringer. Dessuten foreslås det at parten i visse tilfeller skal ha plikt til å medvirke til sakens opplysning når parten selv har innledet saken, f.eks. ved søknad, jf. punkt 21.6.

Kapittel 22 tar for seg spørsmål om informasjon mellom forvaltningen og parten under saksforberedelsen. For det første er det spørsmål om forhåndsvarsling om enkeltvedtak i saker som parten selv ikke innleder, jf. punkt 22.2. For det annet er det spørsmål om plikt til å legge frem opplysninger for parten under saken, jf. punkt 22.3. For det tredje er det spørsmål om partens rett til innsyn i sakens dokumenter, jf. punkt 22.4. Både reglene om forhåndsvarsling og fremlegging er langt på vei foreslått videreført med enkelte mindre endringer, først og fremst knyttet til når organet kan unnlate å varsle eller legge frem opplysninger. Utvalget har også her lagt vekt på å gjøre reglene klarere og enklere å praktisere. Det er f.eks. i seg selv et pedagogisk grep å løfte frem fremleggingsplikten som en særskilt plikt og gi den en egen paragraf. Denne anses i dag som en del av utredningsplikten etter fvl. § 17.

Når det gjelder reglene om partsinnsyn, har utvalget derimot gjort større grep. Istedenfor å foreslå nye regler i ny forvaltningslov har utvalget gått inn for å flytte reguleringen av partsinnsyn over i offentleglova, jf. punkt 22.4.5. Utvalget foreslår som følge av dette enkelte særskilte regler om partsinnsyn i offentleglova, som utvalget dessuten foreslår å gi den nye kortittelen «innsynslova». Utvalget antar at en enhetlig innsynslov kan bidra til et klarere regelverk og en mer enhetlig innsynspraksis, til fordel for både forvaltningsorganene og den enkelte som ønsker innsyn.

I kapittel 23 behandler utvalget spørsmål knyttet til enkeltvedtakets form, innhold og begrunnelse samt underretning til parten. Dette er regler som kommer til anvendelse når forvaltningsorganet har fullført saksforberedelsen og bestemt seg for hvilken avgjørelse som skal treffes. Sentrale spørsmål som her drøftes, er hvilken form vedtaket skal ha (skriftlig eller annen form), hvilke krav som skal stilles til begrunnelsens innhold, og når og hvordan parten skal underrettes om vedtaket, jf. 23.2–23.3. Utvalget foreslår mange videreføringer, men med visse endringer som kan få praktisk betydning. Blant annet er det foreslått en regel som krever at det angis i vedtaket dersom organet har truffet det etter helautomatisert saksbehandling. Utvalget foreslår også å lovfeste at kravene til begrunnelsens innhold vil variere etter sakens betydning. Et sentralt poeng utvalget vil løfte frem i loven, er at begrunnelsen uansett skal tjene til å forklare sakens utfall for parten. Dessuten er det foreslått at avgjørelsesorganet selv skal underrette om vedtaket. Underretningen skal inneholde nærmere angitt praktisk informasjon som parten kan ha behov for.

Kapittel 24 drøfter regler om forvaltningsklage. Utvalget drøfter bl.a. spørsmål om hvilke organer som bør være klageinstans (punkt 24.6), hvilke avgjørelser som bør kunne påklages (punkt 24.7), hvem som bør ha klagerett (punkt 24.8), klagefrist (punkt 24.9), hvilke krav som skal stilles til klagens innhold (punkt 24.10), og hvordan klagen skal behandles i underinstansen og i klageinstansen (punkt 24.11–24.12). Drøftelsene munner ut i et lovforslag som innholdsmessig langt på vei svarer til gjeldende klageordning, men også her med enkelte endringer. Det understrekes i drøftelsene at klageinstansen må organiseres slik at den får tilstrekkelig distanse til underinstansen. En særskilt problemstilling, som utvalget har funnet spesielt vanskelig, er spørsmålet om omfanget av statlig overprøving ved klage over kommunale vedtak, jf. punkt 24.13. Problemstillingen er vanskelig av flere grunner, men ikke minst som følge av at den reiser spørsmål om hvilken vekt hensynet til det kommunale selvstyret skal ha i en avveining mot hensynet til nasjonale hensyn og hensynet til partens ønske om fullgod overprøving, jf. særlig punkt 24.13.4. Utvalget er delt i synet på i hvilket omfang staten skal kunne overprøve kommunens skjønnsutøving. Et flertall foreslår at et statlig organ skal kunne endre forvaltningsskjønnet dersom nasjonale eller vesentlige regionale hensyn taler for det, eller vedtaket er klart urimelig for en part. Et mindretall foreslår en bestemmelse som angir at et statlig organ ved overprøvingen av forvaltningsskjønnet skal legge vekt på det kommunale selvstyret. Et annet mindretall foreslår at det statlige organet skal måtte legge stor vekt på det kommunale selvstyret ved overprøvingen, mens et tredje mindretall foreslår at staten bare skal kunne lovlighetsprøve det kommunale vedtaket og ikke kunne overprøve skjønnet.

I kapittel 25 behandler utvalget regler om retting og omgjøring av enkeltvedtak. Regler om retting er drøftet i punkt 25.5 og knytter seg til situasjoner hvor det er oppdaget klare feil i vedtaket som gjør at det ikke er i overensstemmelse med det som var organets mening. Utvalget foreslår regler om at klare skrive- og regnefeil, utelatelser og tilsvarende bør kunne rettes. I enkelte tilfeller kan det også være en plikt til å rette slike feil. Reglene om omgjøring er drøftet i punkt 25.6 flg. Utvalget drøfter dels i hvilken grad vedtaksorganet kan omgjøre sitt eget vedtak (punkt 25.6), dels i hvilken grad overordnet forvaltningsorgan eller klageinstans kan omgjøre et vedtak (punkt 25.7). Utvalget foreslår langt på vei å videreføre gjeldende omgjøringsregler i forenklet form. Blant annet har utvalget foreslått en regel som istedenfor å henvise til alminnelige forvaltningsrettslige regler, konkret angir i hvilke tilfeller omgjøring skal kunne skje. Utvalget foreslår også en plikt til å omgjøre ugyldige vedtak. I tillegg er det foreslått en generell regel som bestemmer at særskilte klagenemnder ikke skal kunne omgjøre førsteinstansens vedtak. En endring i forhold til gjeldende rett som foreslås av flertallet, er at overordnet organ ikke skal ha en utvidet rett til å omgjøre underinstansens vedtak sammenlignet med vedtaksorganet selv. Utvalget antar at lovforslagene vil kunne bidra til å klargjøre kompetansespørsmålene og til dels også bidra til klarhet i problemstillingene som ofte melder seg ved omgjøring.

I kapittel 26 drøfter utvalget om det bør gjelde særskilte saksbehandlingsregler for avgjørelser som treffes under saksbehandlingen. Utvalget behandler for det første avgjørelser om enkelte saksbehandlingsskritt, f.eks. pålegg om å gi opplysninger, avgjørelser om undersøkelse, beslag eller om konsekvensutredninger. For det annet behandler utvalget andre konkrete avgjørelser om selve saken, bl.a. avgjørelser om avvisning, fristforlengelse og berostillelse. I tillegg til å videreføre gjeldende regler om avvisning, opplysningspålegg og avgjørelser om undersøkelse, foreslår utvalget regler om befaring og beslag.

I kapittel 27 drøfter utvalget hvilke regler som bør gjelde i saker hvor forvaltningen utøver privatautonomi, først og fremst ved å inngå avtaler, men også ved å bruke sin eierrådighet til å treffe privatrettslige disposisjoner ellers. Dette er saker hvor forvaltningsorganene i prinsippet opptrer som enhver annen privatperson. Gjeldende forvaltningslov gir ingen eksplisitt regulering av disse tilfellene, og gjeldende rett på området kan vanskelig anses klar. Utvalget drøfter mange spørsmål om bruk av privatautonomi og kommer til at hensynet til en effektiv ressursbruk, og til dels også hensynet til forutberegnelighet i avtaleforhold, tilsier at forvaltningens privatrettslige disposisjoner bare i begrenset grad skal underkastes saksbehandlingsregler. Det foreslås å gi reglene om inhabilitet og taushetsplikt anvendelse i disse sakene, men ellers unnta denne delen av forvaltningsorganenes virksomhet fra de ellers detaljerte saksbehandlingsreglene i loven.

I kapittel 28 drøftes iverksetting av vedtak og andre avgjørelser. Spørsmålet er på hvilket tidspunkt forvaltningsorganet kan gjennomføre et vedtak etter sitt innhold. Utvalget foreslår å videreføre gjeldende ordning om at avgjørelser som hovedregel kan iverksettes idet de er truffet, med mindre noe annet følger av vedtaket selv eller det er truffet avgjørelse om utsatt iverksetting. Det er videre foreslått å ta inn en lovbestemmelse som presiserer at et forvaltningsorgan står fritt til å bestemme om iverksettingen skal utsettes før klagefristen har utløpt, men likevel slik at iverksetting som hovedregel skal utsettes der den ikke kan gjøres om, eller det er fare for uopprettelig skade på liv eller helse. Utvalget drøfter også regler om tvangsmulkt, direkte gjennomføring og tvangsfullbyrdelse, jf. punkt 28.5. Reglene om tvangsmulkt i gjeldende lov foreslås videreført.

I kapittel 29 drøfter utvalget spørsmål om loven bør gi regler om dekning av sakskostnader som parter eller andre har pådratt seg i forbindelse med saksbehandlingen, herunder særlig klagebehandlingen. Utvalget har merket seg at Norge skiller seg ut med en sakskostnadsregel som åpner for dekning under forvaltningsprosessen der en klage fører til endring til gunst for parten. Spørsmålet om erstatning for kostnader forbundet med forvaltningssaken har reist vanskelige prinsipielle spørsmål. Utvalgets flertall foreslår at den nye forvaltningsloven ikke skal ha en særskilt sakskostnadsregel. Utvalgets mindretall foreslår å opprettholde en viss adgang til dekning, men med forskjellige begrensninger for å avbøte at dagens regel synes å være administrativt krevende å anvende i praksis.

I kapittel 30 flytter utvalget perspektivet noe og behandler enkelte særspørsmål for nemnder. Saksbehandling i nemnder reiser særlige spørsmål på grunn av nemndens organisering (som kollegialt organ) og formen på saksbehandling og avgjørelser (avgjørelser i møter). Viktige enkeltspørsmål har bl.a. vært hvilke regler som skal gjelde for oppnevning av nemndsmedlemmer, herunder om det bør gjelde kvalifikasjonskrav (punkt 30.5.2), hvordan sekretariatsfunksjonen bør reguleres (punkt 30.5.5), og ikke minst hvilke regler som bør gjelde for delegering av myndighet (punkt 30.5.6). Særlige saksbehandlingsspørsmål som drøftes, er bl.a. hvorvidt nemndene skal treffe avgjørelser i møte, om saksbehandlingen skal være skriftlig, når nemndene er vedtaksføre, og hvilke avstemmingskrav som skal gjelde. I tillegg drøftes hvilke særregler som skal gjelde for utforming av begrunnelse og ved avgjørelse av inhabilitet. Det vises til punkt 30.6 for drøftelsen av disse særlige saksbehandlingsspørsmålene. Utvalget foreslår på bakgrunn av drøftelsene i kapittel 30 et eget lovkapittel om regler for organisering og saksbehandling i nemnder i statsforvaltningen. Blant annet er det foreslått regler om oppnevning av medlemmer og leder, om når opphør av verv kan skje, om hvordan nemnda kan delegere sin myndighet internt og til nemndas sekretariat, og nærmere regler om hvordan vedtak treffes, herunder hvilke krav som stilles til vedtaksførhet og stemmeplikt. Regler om nemnder i kommunen og fylkeskommunen er gitt i kommuneloven, og utvalgets forslag er begrenset til nemnder i statsforvaltningen.

I kapittel 31 behandler utvalget spørsmål knyttet til innføring, endring og oppheving av forskrifter, dvs. generelle avgjørelser som bestemmer rettsstillingen for et ubestemt antall personer. Utvalget går nærmere inn på forvaltningsorganets utredningsplikt i forskriftssaker (punkt 31.2), høringsreglene (punkt 31.3), formkrav og kunngjøring (punkt 31.4–31.5), begrunnelse og klage (punkt 31.6) og adgangen til å fravike forskrifter (punkt 31.7). Utvalget har latt seg inspirere av utredningsinstruksen 19. februar 2016 nr. 184 til å foreslå en noe mer fullstendig regulering av saksbehandlingen i forskriftssaker. Enkelte regler som følger av utredningsinstruksen, er derfor foreslått tatt inn i forvaltningsloven, som f.eks. en anbefaling om kunngjøring når et organ begynner et arbeid med å forberede en ny eller endringer i en gjeldende forskrift. I tillegg er reglene i gjeldende lov kapittel VII, om bl.a. utredningsplikt, forhåndsvarsling, formkrav og kunngjøring, foreslått videreført. Som ellers er det søkt å gjøre reglene klarere. Det foreslås å lovfeste at høringer skal være åpne for alle. Utvalget gir uttrykk for at høringsfristen ikke bør settes slik at fristen i realiteten avkortes på grunn av ferier.

I kapittel 32 behandler utvalget særskilte spørsmål som melder seg for uavhengige forvaltningsorganer. Dette er et tema som med årene har fått større og større aktualitet, og som reiser mange viktige spørsmål om organisasjon og ansvar. Ett hovedspørsmål er hva slike organers uavhengighet overhodet innebærer, jf. punkt 32.6. Utvalget legger til grunn at organet er uavhengig særlig når det er unndratt andre organers instruksjons- og organisasjonsmyndighet. Det er videre et spørsmål hvilke organer uavhengighet bør vurderes for, herunder om folkeretten kan stille krav til uavhengighet. Utvalget går konkret inn på en rekke organtyper og vurderer hvorvidt uavhengighet kan være en egnet for deres virksomhet. Dette er drøftet i punkt 32.8. Sentralt for utvalget står spørsmålet om forvaltningsloven bør gi regler om uavhengige organer. Dette henger sammen med at det ofte kan være uklart hva uavhengighet innebærer. Dette kan være uklart både for forvaltningsorganene selv og for den enkelte som har sin sak liggende til behandling hos et uavhengig organ. Utvalget foreslår derfor å gi enkelte regler om hva det innebærer at et organ i statsforvaltningen er uavhengig. Reglene er foreslått inntatt sammen med særskilte regler om nemnder, bl.a. fordi mange nemnder er uavhengige. I tillegg gir utvalget i punkt 32.10.3 uttrykk for synspunkter på hvilke momenter som vil være relevante når det vurderes om organer skal gjøres uavhengige.

Kapittel 33 gjelder konsekvenser av at reglene i forvaltningsloven er brutt, og først og fremst spørsmålet om gyldighet av enkeltvedtak. Gjeldende forvaltningslov gir en gyldighetsregel og regulerer bare når et enkeltvedtak skal anses gyldig på tross av feil ved behandlingsmåten. Utvalget foreslår at loven i stedet bør romme en ugyldighetsregel. Hvordan en slik ugyldighetsregel skal utformes, er drøftet i punkt 33.4. Konklusjonen er at utvalget foreslår en regel som fastsetter at et vedtak er ugyldig når det lider av hjemmelsmangler, og at det etter en nærmere vurdering kan bli ugyldig som følge av skjønnsmangler og saksbehandlingsfeil. Dessuten foreslås det å lovfeste hvilken umiddelbar virkning ugyldighet har, nemlig at vedtaket ikke får virkning etter sitt innhold, samtidig som det foreslås en meget begrenset unntaksregel som gir adgang til å opprettholde vedtaket av hensyn til en part som i god tro har innrettet seg etter det.

I kapittel 34 behandler utvalget spørsmålet om materielle regler som i dag er ulovfestede, bør lovfestes i en ny forvaltningslov. Dette reiser dels spørsmål som også har vært reist andre steder, herunder spørsmålet om hvilket innhold og omfang forvaltningsloven bør ha (eller i hvilken grad loven skal regulere mer enn saksbehandlingen i forvaltningen), dels spørsmål om hvilke fordeler og ulemper en slik lovfesting for øvrig vil kunne ha. Utvalget drøfter om vilkårslæren, misbrukslæren og overvektsprinsippet bør lovfestes, og drøftelsen munner ut i et forslag om å lovfeste vilkårslæren og hovedinnholdet i misbrukslæren.

Kapittel 35 inneholder utvalgets overveielser om lovteknikk og lovens struktur. Det gis bl.a. en begrunnelse for den lovteknikk og lovstruktur som er valgt for utvalgets lovforslag.

Kapittel 36 inneholder utvalgets redegjørelse av lovforslagets administrative, økonomiske og rettssikkerhetsmessige konsekvenser.

Kapittel 37 inneholder merknader til de enkelte paragrafer i lovutkastet («spesialmotivene»).

2.2 English summary

2.2.1 Introduction

The Law Commission on the Public Administration Act was appointed by Royal Decree of 23 October 2015 to conduct a comprehensive review of the current Public Administration Act and related non-statutory administrative law. The Commission’s mandate defined three primary objectives for the Commission’s work: (1) to evaluate the need for changes in view of current practice; (2) to draft a readily comprehensible and user-friendly act as a basis for administrative proceedings that satisfactorily protect both the legal safeguards of citizens and private undertakings and confidence in the public administration while also facilitating efficiency and democratic governance in the context of different organisational forms; and (3) to draft an act reflecting the fact that many public-sector administrative proceedings are already, or will in future be, digitised and facilitating this development.

2.2.2 General comments on the Commission’s proposals

The Commission is proposing a new Act relating to procedure in the public administration (Public Administration Act). The draft act will replace the current Public Administration Act from 1967. Both the Commission’s mandate and the information gathered by the Commission indicate a general consensus that the current act is well-functioning. Nevertheless, amendments are required in various areas.

The draft act is divided into 15 chapters and a total of 95 sections. The number of sections is higher than in the current act. Rules on administrative procedure remain central. The draft act includes provisions on a number of issues not regulated in the current Public Administration Act: the language of proceedings; delegation of official powers by the public administration; the organisation and administrative proceedings of public collegiate bodies (boards), independent public bodies, and various questions related to the content of administrative decisions.

The Commission has sought to give the new act a structure and to use language that make the act as easy to understand and use as possible, for both the public administration and the public. The individual sections reflect the objective of using clear language in the public administration and in legislation. The Language Council of Norway has assisted the Commission in this connection, including with the development of a parallel version of the draft act in the nynorsk form of written Norwegian.

The primary objective of the act is to ensure that public-sector administrative proceedings are sound, confidence-inspiring and efficient. A high priority for the Commission has been to ensure that the act gives citizens confidence in the public administration, as the Commission regards a well-functioning public administration as a key aspect of democratic government. The purpose provision proposed by the Commission underlines the importance of objective conduct and cooperation between administrative bodies as fundamental prerequisites for achievement of the act’s purpose.

The draft act contains provisions concerning regulations, impartiality, the duty to provide guidance, the duty of confidentiality, case preparation, the form of and reasons for decisions, appeals, reversal without appeal and other issues regulated by the current act. The main features of the Public Administration Act will be retained. Emphasis has been given to redrafting retained provisions in clear and modern language to make them easier to apply. It will still be the case that the act’s provisions may be supplemented by special provisions in legislation dealing with specific administrative areas.

The Commission has evaluated the current act by reference to changes in the organisation, working methods, tasks and international obligations of the public administration, including under the EEA Agreement and international human rights conventions. The Commission has taken inspiration from the public administration acts of the other Nordic countries.

The Commission proposes clearer delimitation of the act’s scope. The act will apply to public-sector administrative proceedings at the central government, county and municipal levels, as well as to other parties exercising official powers, regardless of whether such parties are private or public undertakings with an organisational placement outside central and local government. In the case of publicly-owned companies (state-owned enterprises, companies established pursuant to special legislation, publicly-owned limited liability companies, inter-municipal companies or foundations with an official affiliation), the special legislation governing the type of or particular individual undertaking must specify whether the Public Administration Act is to apply to activities other than the exercise of official powers.

Emphasis has been given to ensuring that the act functions equally well at the local and central government levels. The Commission has referred the Municipalities Act of 2018 as the basis for its work.

Like the current act, the draft act contains detailed administrative rules applicable to individual administrative decisions. The Commission does not consider it appropriate to introduce multiple sets of administrative rules for different types of decisions. The detailed administrative rules will apply to the exercise of official powers in individual cases. The Commission’s proposal entails clarification, in the act, of which decisions constitute individual administrative decisions. The Commission is also proposing detailed administrative rules on individual administrative decisions which are sufficiently flexible to ensure appropriate, efficient processing of different types of cases while also inspiring confidence in the public administration among the members of the public.

The draft act facilitates further digitalisation of administrative activities. The individual provisions are in principle intended to be technology-neutral. The draft act envisages that administrative proceedings may be fully automated following detailed assessment of relevant areas, subject to a requirement that the legal content of the system must be publicly documented. The Commission has also examined particular challenges presented by digitalisation and automation in the data protection context. These raise difficult issues both nationally and under international law; see particularly the EU General Data Protection Regulation (GDPR). The Commission is proposing an expanded power for administrative bodies in the central government, county and municipal sectors to share confidential information. In the case of personal data, it is proposed that this power be granted subject to conditions that satisfy GDPR requirements.

The impartiality rules have been reviewed. While the Commission proposes retention of the disqualification threshold, it is also proposing that certain situations that, at present, often result in disqualification following a discretionary overall assessment should result in disqualification automatically. This applies, for example, to persons with a material financial interest in the outcome of a matter. The Commission is also proposing disqualification of persons who, in the 12 months preceding the initiation of a case, have held a post or leading position within a company that is party to the case. The proposal will disqualify a person who has made a first-instance decision in an administrative case from dealing with a subsequent appeal. As regards disqualification following a discretionary overall assessment, the Commission is proposing codification of additional aspects of the assessment topic. The Commission is proposing that the disqualification rules should also apply formally to members of the government, except in the case of appeals to the King.

The Commission proposes retention of the current system of administrative appeals and the current rules determining which body is to function as the appellate body. However, the Commission has also emphasised the need to ensure that the appellate body has an organisational position that gives it sufficient distance from the subordinate body. In the public administration, this applies both when the appellate body is the «immediate superior body» and when it is a special appeals board. The Commission members were split in their views on how far a central-government appellate body may go in reviewing the administrative discretion inherent in a decision made by a municipality or county authority. The majority of the Commission proposes repeal of the right to legal costs in administrative cases.

The Commission has analysed what it means for an administrative body to be «independent». The report also discusses the use of independent bodies in the public administration and sets out guidelines for the organisation and future establishment of independent bodies.

The specific content of the report is summarised in greater detail below. Reference is also made to chapter 36 for an overview of the most important proposed changes. In that chapter, the Commission discusses the financial, administrative and rule-of-law consequences of the changes that are proposed.

2.2.3 Overview of the report structure and individual chapters

The report comprises 35 chapters, which collectively set out and detail the Commission’s proposed new Public Administration Act.

Chapter 3 presents the Commission’s work.

Chapter 4 provides an overview of developments in the public administration. The emphasis is on developments in the organisational structure, tasks and working methods of the public administration since 1960. In chapter 5, the Commission describes the organisational structure and tasks of the public administration in 2019. These chapters give a factual description of the realities administrative law must regulate.

Chapter 6 contains both legal and factual descriptions and provides an overview of the main content of the Public Administration Act and the act’s history of the to date. Chapter 6 also examines the relationship between the Public Administration Act and administrative-law provisions in other legislation (special legislation), as well as the relationship between the Public Administration Act and non-statutory administrative-law provisions (procedural, personnel-related, organisational and substantive rules). Further, the Commission conveys its impression of the Public Administration Act in practice.

Chapter 7 of the report contains a comprehensive, general presentation of Norway’s most important international obligations of relevance to the drafting of the new Public Administration Act. This chapter discusses key international-law obligations, including obligations pursuant to human rights law, for example under the European Convention on Human Rights, relevant UN treaties and EU/EEA law. Certain other obligations and guidelines are also discussed, including the Aarhus Convention, the Indigenous and Tribal Peoples Convention and anti-corruption conventions, as well as certain Council of Europe recommendations. As stated in the chapter, only a minority of international-law obligations confer procedural rights on individuals involved in administrative cases. Rather, several of them contains provisions on how public bodies should be organised and how public officials should act in the performance of their official duties.

Chapter 8 presents an overview of the main features of all the Nordic public administration acts.

Collectively, chapters 3 to 8 provide a factual – and to some extent a legal – backdrop for the investigation and revision work. From chapter 9 onwards, the report becomes more specific as regards the need for and proposed form of a new Public Administration Act.

In chapter 9, the Commission discusses the need to revise the Public Administration Act. General perspectives on revision of the act are set out. Important issues which are covered include what values are central to the activities of the public administration, what tasks, instruments and working methods are available to the public administration, and what form and structure a new Public Administration Act should be given. Detailed consideration is also given to the need for a new act, as opposed to revision of the current act. The Commission has decided to propose a new act, which must be adapted to expectations and developments in the organisation and working methods of the public administration, and must be drafted in clear language.

In chapter 10, the Commission builds on the discussion in chapter 9, detailing the values, expectations and objectives the Public Administration Act must serve. In this regard, the Commission has concluded that legal safeguards, efficiency, modest resource use, democratic government and public confidence are the most important considerations on which a new act should be founded. The discussion culminates in an examination of the purpose of the act, with the Commission proposing a purpose provision drafted to express that the act is intended to facilitate sound, confidence-inspiring and efficient public-sector administrative proceedings that protect the interests of both individuals and society at large.

Chapter 11 contains the Commission’s discussion of general issues relating to the content of the Public Administration Act. More specifically, the discussed issues are whether the Public Administration Act should be framed minimalistically or, conversely, regulate the activities of the public administration exhaustively. This influences what provisions the Commission must evaluate and, potentially, propose – these questions are discussed specifically in section 11.9. A further question is how public-sector administrative proceedings can be regulated in different ways. This encompasses the relationship between statutory regulation, general instructions, ethical guidelines and the requirement of good administrative conduct; see sections 11.4–11.5. A key issue is whether general principles applicable to administrative proceedings should be codified, see sections 11.6–11.7, and the discussion includes whether a legal requirement for appropriate system design should be introduced; see section 11.8. The Commission proposes that the act should, in principle, apply to all matters dealt with by the public administration. If needed, special rules may still be issued for specific case types or administrative bodies. It is proposed that the purpose provision should state that administrative bodies must conduct their activities on the basis of objectivity and cooperation – two guiding principles the Commission considers central to sound and effective public administration.

In chapter 12, the Commission discusses what scope the act should have, i.e. to which bodies and activities the act should apply. The Commission proposes that, as at present, the act should apply to all administrative bodies in the central government, county and municipal sectors. The act should not apply to the Storting (the Norwegian parliament) or bodies of the Storting, or to the courts. The Commission has included detailed discussion of special issues raised by state-owned enterprises, companies established pursuant to special legislation, inter-municipal companies, other companies and organisations, foundations and funds, but has concluded that the consideration of clear delineation and simple rules indicates that these bodies should only be subject to the act when they exercise official powers. Private parties should be covered by the act when they exercise delegated official powers. As at present, the act should not apply to the police or the prosecuting authority when they are dealing with matters under the Criminal Procedure Act.

Chapter 13 discusses various rules of general relevance to almost all administrative cases. The discussion covers matters such as the initiation of administrative cases, the relationship between case preparations and a decision, decisions resulting from automated administrative proceedings, other opportunities offered by digitalisation, and the relationship between written and oral administrative proceedings; see sections 13.1–13.4. The discussions culminate in, among other things, a proposal to retain the general rule that administrative proceedings must be conducted in writing. At the same time, however, the act must facilitate further digitalisation of administrative activities. The requirement for written proceedings is intended to ensure thoroughness, while the purpose of digitalisation is to secure efficiency.

Further, section 13.5 discusses a range of issues linked to language use within the public administration. The Commission has emphasised the desirability of ensuring that the public administration communicates in a correct, clear and user-focused manner. Moreover, the public administration should, in various contexts and when necessary, assist with the translation of documents for involved parties. The Commission proposes codification of the principles that the language of the public administration is Norwegian and that administrative bodies must communicate using clear and precise language that, wherever possible, is tailored to the individual. In addition, some rules are proposed on the translation of central documents. As regards provisions on interpretation, however, it is proposed that these be included in a potential new act on public-sector interpretation, based on the proposal in Official Norwegian Report (NOU) 2014:8 on interpretation in the public sector.

In section 13.6, the Commission discusses the general question of who should be considered parties with expanded rights in certain administrative cases. The Commission is proposing a new legal definition that aims to clarify the term «party». In section 13.7, the Commission discusses important questions related to case-processing times in the public administration, including what instruments could potentially contribute to quicker case processing. The Commission’s proposal is that administrative bodies should have to specify the probable case-processing time when they receive an application, or at the latest when sending a preliminary reply within one month. It is also envisaged that case-processing times may be detailed in special legislation or regulations. Finally, in section 13.8, the Commission discusses how the general costs of administrative proceedings should be allocated between the public sector and private parties. The question is whether the charging of fees for the processing of cases, including appeals, should be permitted. The Commission proposes that regulatory legal authority for doing so should be retained, but that fees linked to appeals should be repaid if an appeal succeeds in full or in part.

Chapter 14 contains the Commission’s discussion of organisational questions concerning the distribution of authority within the public administration. Key questions include what duties individual administrative bodies (as opposed to multiple administrative bodies or the public administration in general) have in administrative proceedings and what should be deemed to constitute a single administrative body (as opposed to other administrative bodies). The Commission also discusses how administrative proceedings can be coordinated in cases in which multiple decisions are made jointly; see section 14.3.4.

In chapter 15, the Commission discusses issues relating to the delegation of authority within the public administration. The majority of the discussion focuses on delegation within the public administration; see section 15.6. The need to delegate and codify rules on delegation is discussed in section 15.5. The Commission considers that the rules on delegation should be codified, not least because this may help to clarify delegation processes and provide a clearer authority structure. In particular, rules are required for cases where authority is delegated to private parties. This is discussed separately in section 15.6.7. The Commission proposes several delegation rules, including on the power to delegate, as well as certain requirements relating to the actual delegation decision. The rules will primarily apply to delegation by public administrative bodies. The Commission also discusses issues linked to the use of private parties for case preparations, see section 15.9.2, and proposes a rule permitting such use subject to a duty requiring the involved body to conduct an independent assessment of the case before a decision is made.

The Commission discusses the question of the impartiality of public officials in chapter 16. The Commission proposes simplification of the rules through linguistic and structural changes compared to the current impartiality rules. In addition, content-related amendments are proposed that will result in automatic disqualification in a wider range of cases. Examples include equating cohabitation with marriage, expanding the class of relationships that lead to automatic disqualification, including friendship and hostility as grounds for disqualification and introducing a one-year quarantine period in connection with certain representative relationships. It is proposed that the topic of assessment in connection with disqualification following a discretionary overall assessment be expanded and clarified. In principle, the provisions of the Public Administration Act should also apply to ministers when they act on behalf of the government.

In chapter 17, the Commission considers general questions arising in connection with the informational and guidance activities of the public administration. The Commission discusses whether the Public Administration Act should contain a rule establishing a general duty for administrative bodies to provide information, but does not propose this. Further, the Commission proposes retention of the provisions on the general duty of administrative bodies to provide guidance, and puts forward rules designed to clarify the content and scope of this duty. The Commission is also proposing codification of the guidance requirements currently found in the Regulations relating to the Public Administration Act, primarily those concerning the procedure to be followed when giving guidance.

Chapter 18 contains the Commission’s discussion of special issues linked to digital administrative proceedings and communication. Issues raised by automated decision-making processes are key; see section 18.3.3. Such decision-making processes raise difficult questions regarding the legal basis for fully automated processing of personal data, documentation of decision-making system content, public access to legal system content, handling of non-conformances, profiling and artificial intelligence. These questions are discussed by the Commission in section 18.3. This topic also raises the question of how the Public Administration Act should be coordinated with requirements relating to the processing of personal data as laid down in the GDPR. One measure taken by the Commission to ensure satisfactory harmonisation of the Public Administration Act with the data protection rules is to authorise the issuance of regulations stating that administrative bodies may, in specific areas, make decisions using fully automated administrative proceedings. Moreover, a provision has been included which permits decisions with a low impact on individuals to be made without legal authority in regulations. The Commission is also proposing codification of certain requirements as to documentation of automated decision-making systems.

In section 18.3.4, the Commission discusses whether citizens should have a right, and possibly a duty, to communicate digitally with the public administration. This question encompasses issues such as accessibility, efficiency and resource use in general, which the Commission discusses in detail. The Commission is not proposing such a duty for citizens, but is proposing a duty for the public administration to be accessible and to enable individuals to contact the public administration securely and efficiently.

Chapter 19 deals with the duty of confidentiality and information-sharing. Many consider the confidentiality rules to be particularly complicated. However, the rules safeguard important considerations by protecting personal and other sensitive information. Breach of the rules therefore incurs criminal liability. The Commission discusses the possibilities for clarifying the rules that determine what information is subject to a duty of confidentiality, but does not propose fundamental statutory changes. In sections 19.8–19.11, the Commission discusses issues such as the content of the duty of confidentiality, who should be subject to the duty, what information should be confidential, what restrictions should apply to the duty and when the duty should lapse.

As stated, the Commission also discusses the question of information-sharing; see section 19.12. The GDPR is highly relevant in this context, since the sharing of information subject to a duty of confidentiality often involves the processing of personal data. Among other things, the Commission discusses whether sharing should be permitted and, if so, to what extent. While the «once only» principle indicates that sharing should be permitted on a large scale, data protection considerations indicate otherwise. In sections 19.12.3–19.12.10, the Commission discusses sharing with parties to a case and their representatives, intra-organisational sharing, sharing with other administrative bodies and various other sharing-related issues. The Commission’s proposal is that more extensive information-sharing should be permitted between administrative bodies in accordance with the «once only» principle, but also that data protection considerations should not be neglected. The proposal is intended to facilitate smoother, more efficient data processing in the public sector, and thus also improved administrative proceedings for individuals. To protect confidential information, the Commission proposes rules on access control and traceability.

All of the chapters discussed up to this point should be of general interest to administrative bodies, as most of the examined issues may arise regardless of the type of administrative activity. In chapter 20, the Commission goes a step further, asking whether specific decision types should be regulated in greater detail. One major question is to what decisions the individual provisions of the act, including the special administrative rules, should apply. Particular attention is given to the question of whether substantive decisions should be subject to special rules and, if so, to which substantive decisions this should apply. In reality, this discussion concerns the distinction between individual administrative decisions and other decisions. This is partly a question of how the term «individual administration decision» should be delineated, and partly a question of what rules should apply to other decisions. The Commission concludes that special rules should continue to apply to substantive decisions made during the exercise of official powers, and that these should continue to be referred to as individual administrative decisions. The Commission proposes a new legal definition of the term «individual administrative decision», with the aim of clarifying which decisions are meant. The act must specify certain types of decision that are always regarded as individual administrative decisions.

The topics discussed in chapters 21 to 25 have in common that they primarily concern case preparations in cases involving individual administrative decisions. Chapter 21 examines the duty to investigate, with the Commission discussing the content and scope of the duty. The question is what duty administrative bodies should have to ensure that the decision-making basis in a case is good enough to make a sound decision. The duty to investigate raises questions related to the balancing of thoroughness with reasonable resource use. The Commission’s proposal largely envisages retention of the current rules, albeit with linguistic and structural changes. Moreover, it is proposed that a party should in certain instances have a duty to contribute to clarification of the case when it has initiated the case itself, for example by filing an application; see section 21.6.

Chapter 22 discusses questions related to information-provision by the public administration to involved parties during case preparations. The first question concerns prior notification of individual administrative decisions in cases not initiated by the involved party; see section 22.2. The second question concerns the duty to disclose information to involved parties during the case; see section 22.3. The third question concerns involved parties’ right to disclosure of case documents; see section 22.4. The Commission’s recommendation is that the rules on both prior notification and disclosure largely be retained, with some minor amendments. These amendments relate primarily to when a body may decide not to give notice or disclose information. The Commission has once again emphasised making the rules clearer and simpler to apply. For example, highlighting the disclosure duty as an independent duty and placing it in a separate paragraph is an educational measure in itself. At present, this duty is considered part of the duty to investigate pursuant to section 17 of the Public Administration Act.

As regards the rules on party disclosure, however, the Commission has adopted more wide-ranging measures. Instead of proposing new rules in the new Public Administration Act, the Commission is proposing to move regulation of party disclosure into the Freedom of Information Act; see section 22.4.5. The Commission is therefore also proposing the inclusion of a number of special rules on party disclosure in the Freedom of Information Act, which the Commission also proposes should be given the new short title, «Disclosure Act». The Commission considers that a comprehensive disclosure act would help clarify the applicable rules and ensure more uniform disclosure practice, for the benefit of both administrative bodies and individuals seeking disclosure.

In chapter 23, the Commission discusses questions related to the form and content of and statements of reasons in individual administrative decisions, as well as notification of parties. These rules apply when an administrative body has completed case preparations and determined what decision it intends to make. Key questions discussed in this regard are what form a decision must take (written or otherwise), what requirements must apply as to the content of the statement of reasons, and when and how a party must be informed of the decision; see sections 23.2–23.3. The Commission is proposing that numerous provisions be retained, but also that some changes of potential practical significance should be made. Among other things, a rule is proposed that requires decisions made by a body following fully automated administrative proceedings to be identified as such. The Commission is also proposing codification of the principle that the required content of the statement of reasons will vary according to the importance of the case. A key factor the Commission wishes to highlight in the act is that the statement of reasons must in any event serve to explain the outcome of the case to involved parties. Moreover, it is proposed that decision-making body itself must give notice of the decision. This notice must contain specified practical information the notified party may need.

Chapter 24 discusses the rules governing administrative appeals. The Commission discusses questions such as which bodies should function as appellate bodies (section 24.6), which decisions should be appealable (section 24.7), who should have a right of appeal (section 24.8), the appeal deadline (section 24.9), what requirements should apply as to the content of an appeal (section 24.10) and how an appeal must be processed by the subordinate body and the appellate body (sections 24.11–24.12). This discussion has resulted in a draft act whose contents largely correspond to the present appeal system, albeit with some changes. In the discussion, it is emphasised that the appellate body must be organised in such a way that it has sufficient distance from the subordinate body. A special issue the Commission has found particularly difficult to resolve is the question of the scope of central government review in the context of appeals against municipal decisions; see section 24.13. This is a complicated issue for several reasons, but not least because it raises the question of what weight the consideration of municipal self-government should carry when balancing this consideration with national interests and the interest of the involved party in securing a satisfactory review; see particularly section 24.13.4. The Commission was split in its view on the scope to be granted to central government in reviews of discretionary decisions at the municipal level. The majority’s proposal is that central government bodies should be permitted to amend a discretionary administrative decision if national or material regional interests so indicate, or if the decision is clearly unreasonable with respect to a party. One minority proposes a provision stating that central government bodies must give weight to municipal self-government when reviewing discretionary administrative decisions. A second minority proposes that central government bodies must give great weight to municipal self-government when conducting a review, while a third minority proposes that central government should only be permitted to review the legality of a municipal decision, not any exercise of discretion.

In chapter 25, the Commission examines rules on the rectification and reversal of individual administrative decisions. The rectification rules are covered in section 25.5, and relate to situations where clear errors are discovered in a decision such that it is inconsistent with the public body’s intention. The Commission is proposing rules stating that clear spelling mistakes and miscalculations, omissions, etc. may be rectified. Moreover, a duty to rectify such errors may arise in some cases. The rules on reversal are discussed in section 25.6 onwards. The Commission’s discussion covers both the extent to which a decision-making body may reverse its own decision (section 25.6) and to what extent a superior administrative body or appellate body may reverse a decision (section 25.7). The Commission largely proposes retention of the current reversal rules, albeit in simplified form. Among other things, the Commission is proposing a rule that – rather than referring to general provisions of administrative law – details the specific instances in which reversal is permitted. The Commission also proposes a duty to reverse invalid decisions. In addition, a general rule is proposed that states that special appeals boards may not reverse first-instance decisions. One change to the current legislation proposed by the Commission majority is that a superior body should not have a broader right to reverse subordinate-body decisions than the actual decision-making body. The Commission envisages that these legislative proposals will help to clarify jurisdictional issues and in part help to resolve the issues that often arise in connection with reversal.

In chapter 26, the Commission considers whether special administrative rules should apply to decisions made in administrative proceedings. The Commission has considered, firstly, decisions related to certain procedural steps, such as orders to disclose information and decisions concerning investigation, seizure and impact assessments. Second, the Commission has examined other specific decisions relating to a specific case, including decisions concerning dismissal, deadline extensions and discontinuation. In addition to retaining the current rules on dismissal, disclosure orders, and investigation decisions, the Commission is proposing rules on inspections and seizure.

Chapter 27 contains the Commission’s discussion of what rules should apply in cases where the public administration exercises its private autonomy, primarily by entering into agreements but also by using its ownership rights to implement other types of private transaction. In principle, such cases are ones in which administrative bodies act in the same capacity as any other private person. The current Public Administration Act does not regulate such instances explicitly, and current legal regulation of this area is unclear. The Commission has thoroughly discussed many issues concerning the exercise of private autonomy and concluded that the consideration of efficient resource use, and partly also the consideration of foreseeability in contractual relationships, indicate that private-law transactions entered into by the public administration should only be subject to administrative rules to a limited degree. The proposal is to make the rules on disqualification and the duty of confidentiality applicable to such cases, but otherwise to exempt this aspect of the activities of administrative bodies from the detailed administrative rules in the act.

Chapter 28 discusses the implementation of administrative and other decisions. The question is at what point in time an administrative body may implement a decision in accordance with its contents. The Commission proposes retention of the current system whereby decisions may generally be implemented once they are made, unless the decision itself states otherwise or a deferred-implementation decision has been made. A further proposal is to include a statutory provision clarifying that an administrative body is free to decide whether implementation should be deferred until the appeal deadline has expired, subject to the requirement that implementation must generally be deferred if it cannot be reversed or there is a risk of irremediable injury to life or health. The Commission also discusses rules on coercive fines, direct implementation and enforcement; see section 28.5. It is proposed that the rules on coercive fines in the current act be retained.

In chapter 29, the Commission discusses the question of whether the act should contain rules on reimbursement of legal costs incurred by parties or others in connection with administrative proceedings, including appeal proceedings in particular. The Commission has noted that Norway’s legal costs rule is unusual in permitting reimbursement during administrative proceedings when an appeal results in amendment in favour of the appealing party. The question of reimbursement of costs connected to administrative cases raises difficult questions of principle. The majority of the Commission proposes that the new Public Administration Act should not contain a separate legal costs rule. The Commission minority, on the other hand, wishes to maintain some scope for reimbursement – albeit subject to various restrictions to remedy the fact that the current rule appears to be administratively difficult to apply in practice.

In chapter 30, the Commission shifts its focus onto certain special issues related to public boards. Administrative proceedings before such boards raise special issues due to their organisational structure (collegiate bodies) and the form of administrative proceedings and decisions (decisions made at meetings). Important individual questions have included what rules should apply with respect to the appointment of board members, including whether qualification requirements should apply (section 30.5.2), how the secretariat function should be regulated (section 30.5.5) and, not least, what rules should apply with regard to the delegation of authority (section 30.5.6). Particular questions discussed in relation to administrative proceedings include whether boards should make decisions at meetings, whether administrative proceedings should take place in writing, when boards are quorate and what voting requirements should apply. Other discussed issues were what special rules should apply as to the form of statements of reasons and to disqualification decisions. Section 30.6 contains discussion of these special questions concerning administrative proceedings. Based on the discussion in chapter 30, the Commission proposes the inclusion of a dedicated chapter in the act setting out rules on the organisation and administrative proceedings of public boards. The proposals include rules on the appointment of members and chairpersons, when an appointment may cease and how boards may delegate their powers internally and to the board secretariat, as well as detailed provisions on the making of decisions, including what requirements apply with regard to being quorate and the duty to vote. The Local Government Act contains rules on municipal and county boards, and the Commission’s proposals are restricted to public boards.

In chapter 31, the Commission considers questions related to the issuance, amendment and repeal of regulations, i.e. general decisions determining the legal position of an undefined number of persons. The Commission engages in detailed discussion of the duty of administrative bodies to investigate in cases concerning regulations (section 31.2), the rules on hearings (section 31.3), formal requirements and announcements (sections 31.4–31.5), statements of reasons and appeals (section 31.6) and authority to depart from regulations (section 31.7). The Commission took inspiration from the instructions for the official report dated 19 February 2016 no. 184, in proposing somewhat more complete regulation of administrative proceedings in cases concerning regulations. Accordingly, certain provisions that follow from the instructions have been proposed for inclusion in the Public Administration Act, such as a recommendation that an announcement be made when a body begins work on new or amended regulations. In addition, retention is recommended of the provisions in chapter VII of the current act concerning e.g. the duty to investigate, prior notification, formal requirements and announcement. As elsewhere, the aim is to make the rules clearer. Codification is proposed of the principle that hearings must be open to all. The Commission states, among other things, that hearing submission deadlines should not be set such that the deadline is effectively shortened due to holidays.

Chapter 32 contains the Commission’s discussion of special issues raised by independent administrative bodies. This topic has become increasingly relevant over the years, and raises many important questions concerning organisational structure and responsibility. One primary issue is the general implications of the independence of such bodies; see section 32.6. The Commission has concluded that bodies are independent particularly when they are not subject to the organisational authority of other bodies, or their authority to issue instructions. A further question is which bodies should be made independent, including whether independence may be required under international law. The Commission discusses various types of bodies specifically, assessing whether their activities may be suited to independent status. This is discussed in section 32.8. However, a central consideration for the Commission is whether the Public Administration Act should contain rules on independent bodies. This question is linked to the fact that the consequences of independence may often be unclear. The consequences may be unclear both to the administrative bodies themselves and to individuals whose cases are being processed by an independent body. The Commission is therefore proposing certain rules specifying what it entails for a public body to be independent. The proposal is to incorporate the rules together with special rules on public boards, not least because many boards are independent. In addition, in section 32.10.3 the Commission discusses which factors will be relevant when evaluating whether a body should be made independent.

Chapter 33 deals with the consequences of breach of the provisions of the Public Administration Act – primarily the question of the validity of individual administrative decisions. The current Public Administration Act contains a validity rule and only regulates when an individual administrative decision must be deemed valid despite containing a procedural error or errors. The Commission is proposing that the act should instead include an invalidity rule. The framing of the invalidity rule is discussed in section 33.4. The Commission has decided to propose a rule that specifies when a decision is invalid due to defects in legal authority and when a decision may be held invalid – following a detailed assessment – based on errors in the exercise of discretion and procedural errors. Moreover, it is proposed that the immediate effect of invalidity be codified, namely that the decision does not take effect in accordance with its contents, and a very limited exception provision is proposed that permits a decision that lacks legal authority to be upheld for the benefit of a party acting in good faith.

In chapter 34, the Commission considers the question of whether substantive rules that are currently non-statutory should be codified in the new Public Administration Act. This topic raises issues that have also arisen in other areas, including particularly the question of what content and scope the Public Administration Act should have (or to what degree the act should regulate matters other than public-sector administrative proceedings). A further question is what advantages and potential disadvantages such codification may entail. The Commission discusses, among other things, whether the conditions principle, the abuse principle and the preponderance of the evidence rule should be codified, and concludes that the so-called conditions principle and the main content of the abuse principle should be codified.

Chapter 35 sets out the Commission’s thoughts regarding technical drafting solutions and the structure of the act. Among other things, reasons are provided for the drafting solutions and structure chosen for the Commission’s draft act.

Chapter 36 contains the Commission’s explanation of the administrative, financial and rule-of-law consequences of the draft act.

Chapter 37 contains comments on the individual sections of the draft act.
