3 Instrument for the amendment of the constitution of the International Labour Organisation
The General Conference of the International Labour Organisation,
Having been convened at Geneva by the Governing Body of the International Labour Office, and having met in its Eighty-fifth Session on 3 June 1997, and
Having decided upon the adoption of an amendment to the Constitution of the International Labour Organisation, a question which is included in the seventh item on the agenda of the Session;
adopts, this nineteenth day of June of the year one thousand nine hundred and ninety-seven, the following instrument for the amendment of the Constitution of the International Labour Organisation, which may be cited as the Constitution of the International Labour Organisation Instrument of Amendment, 1997:
Article I
As from the date of the coming into force of this Instrument of Amendment, article 19 of the Constitution of the International Labour Organisation shall be amended by the insertion after paragraph 8 of the following new paragraph:
«9. Acting on a proposal of the Governing Body, the Conference may, by a majority of two-thirds of the votes east by the delegates present, abrogate any Convention adopted in accordance with the provisions of this article if it appears that the Convention has lost its purpose or that it no longer makes a useful contribution to attaining the objectives of the Organisation.»
Article 2
Two copies of this Instrument of Amendment shall be authenticated by the signatures of the President of the Conference and of the Director-General of the International Labour Office. One of these copies shall be deposited in the archives of the International Labour Office and the other shall be communicated to the Secretary-General of the United Nations for registration in accordance with article 102 of the Charter of the United Nations. The Director-General will communicate a certified copy of the Instrument to all the Members of the International Labour Organisation.
Article 3
1. The formal ratifications or acceptances of this Instrument of Amendment shall be communicated to the Director-General of the International Labour Office, who shall notify the Members of the Organisation of the receipt thereof.
2. This Instrument of Amendment will come into force in accordance with the provisions of article 36 of the Constitution of the International Labour Organisation.
3. On the coming into force of this Instrument, the Director-General of the International Labour Office shall so notify all the Members of the International Labour Organisation and the Secretary-General of the United Nations.
Dokument om endring av Den internasjonale arbeidsorganisasjons konstitusjon
Den internasjonale arbeidsorganisasjons generalkonferanse,
som av Styret for Det internasjonale arbeidsbyrå er blitt sammenkalt i Geneve, og som har trådt sammen til sin 85. sesjon den 3. juni 1997,
og som har besluttet å vedta en endring i konstitusjonen for Den internasjonale arbeidsorganisasjon, et spørsmål som er tatt med i punkt 7 i sesjonens dagsorden,
vedtar i dag, den 19. juni 1997, følgende dokument om endring av konstitusjonen for Den internasjonale arbeidsorganisasjon.
Dokumentet kan kalles «Dokument av 1997 om endring av konstitusjonen for Den internasjonale arbeidsorganisasjon».
Artikkel 1
Fra den dag dette endringsdokumentet trer i kraft, skal artikkel 19 i konstitusjonen for Den internasjonale arbeidsorganisasjon, bli endret ved at følgende nye punkt blir føyd til etter punkt 8:
«9. Konferansen kan, etter forslag fra Styret, ved 2/3-dels flertall av de avgitte stemmer fra de representantene som er tilstede, oppheve enhver konvensjon - i samsvar med bestemmelsene i denne artikkel - dersom det viser seg at konvensjonen ikke lengre tjener noe formål eller at den ikke lengre har noen nyttefunksjon når det gjelder å virkeliggjøre organisasjonens målsettinger».
Artikkel 2
To autentiske eksemplarer av dette endringsdokumentet skal undertegnes av Presidenten for konferansen og av Generaldirektøren for Det internasjonale arbeidsbyrå. Ett av disse eksemplarene skal deponeres i arkivet til Det internasjonale arbeidsbyrå, og det andre skal oversendes Generalsekretæren for De forente nasjoner til registrering i samsvar med artikkel 102 i FN-pakten. Generaldirektøren vil sende en bekreftet kopi av dokumentet til hver medlemsstat i Den internasjonale arbeidsorganisasjon.
Artikkel 3
1. De formelle ratifikasjoner eller godkjennelser av dette endringsdokumentet skal oversendes Generaldirektøren for Det internasjonale arbeidsbyrå, som så skal underrette medlemsstatene i organisasjonen om at de er mottatt.
2. Dette endringsdokumentet vil tre i kraft i samsvar med reglene i artikkel 36 i organisasjonens konstitusjon.
3. Når dette dokumentet trer i skal, skal Generaldirektøren for Det internasjonale arbeidsbyrå gi melding om det til alle medlemsstater i Den internasjonale arbeidsorganisasjon og til Generalsekretæren for De forente nasjoner.
